Users must read this document carefully.
Although the entire contractual relationship relating to these Products is solely between the Owner and the User, the User acknowledges and agrees that if the Application is made available to them through the Apple App Store, Apple may enforce these Terms as a third party beneficiary.
Please note that certain provisions of these Terms may apply only to certain categories of Users. In particular, certain terms may apply only to consumers or users who do not qualify as consumers. Such limitations are always expressly mentioned in each affected clause. In the absence of any such reference, the Terms apply to all Users.

1. Order submission.
When a user submits an order, the following applies:
The submission of an order determines the conclusion of a contract and the User is therefore obliged to pay the price specified on the order page, taxes and possible further fees and expenses.
If the purchased product requires active input from the user, such as the provision of personal information or data, specifications or special wishes, the user is obliged to cooperate accordingly after submitting the order.
After submitting an order, the user will receive a receipt confirming that the order has been received.
All notifications related to the stated purchase process shall be sent to the email address provided by the User for this purpose.
2. Age and Authority Requirements.
Whisper AI takes children's online safety seriously and does not wish to receive information from children under the age of 18. Accordingly, you may not post or submit on or through the Services any personal information of a child under the age of 18 or information sufficient to locate such a child. If you are under 18, please do not attempt to submit any information to or use the Services.
If you are accepting these Whisper AI Terms of Service on behalf of another person or entity, you affirm that you have the legal authority to accept the Whisper AI Terms on their behalf. You may not provide your access credentials or account to others, and you are responsible for all activities that occur under your account.
3. Your use of Whisper AI.
3.1 Using Whisper AI. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable right to use Whisper AI and its Robots.
3.2 User confirmation. You acknowledge and agree:
Bots accessed through Whisper AI should not be relied upon in emergency situations; a bot may claim to perform actions for you in the real world but may not take any action other than respond to you;
Bots accessed through Whisper AI may not generate accurate information and the information provided may be out of date. You should independently verify responses or suggestions provided by any bot on Whisper AI. Whisper AI does not provide any guarantee or guarantee as to the accuracy of any information provided through Whisper AI;
Whisper AI and the robots on Whisper AI are subject to modifications and changes and may contain bugs, design flaws, or other problems;
Use of Whisper AI or the robots on Whisper AI may result in unexpected results, loss of data or communications, or other anticipated or unanticipated damage or loss;
Whisper AI or the bots on Whisper AI may not function properly, reach final form, or be fully functional; your access to Whisper AI or the bots is not guaranteed;
3.3 Restricted Use. You agree not to use Whisper AI or the robots on Whisper AI for the following purposes:
Violate the rights of another party or any applicable law;
Violate these Terms or our policies, or the policies of the third-party providers powering the bots on Whisper AI.
Reverse assemble, decompile, decompile, translate or otherwise attempt to discover the model, algorithm and system source code or underlying components of Whisper AI, the robot or its underlying technology;
Abuse, harm, interfere with, reverse engineer or disrupt Whisper AI, the robots or their underlying technology, such as by accessing or using them in a fraudulent or deceptive manner, introducing malware, spamming, hacking or bypassing any protection measures;
Use Whisper AI or bots in an automated manner, such as in excess of any rate limits specified by us from time to time;
Use Whisper AI or Robots to develop products, applications, services, base models, or other large-scale models that compete with Whisper AI, Robots, and their underlying technology;
Use any method to extract data from Whisper AI or the bots, including web scraping, web harvesting, or web data extraction methods, except as permitted by these Whisper AI Terms of Service; or
Indicates that bot-generated content (as defined below) is human-generated.
3.4 Feedback. We welcome your feedback and suggestions on how to improve Whisper AI or the bots on Whisper AI. By submitting Feedback, you agree to grant us the right, in our sole discretion, to use, reproduce, disclose, create derivative works from, display, publish and otherwise exploit the Feedback, in whole or in part, free of charge and without any compensation to you. 4. Your Content.
4.1 Your Content. Whisper AI may allow you to ask questions, create bookmarks, vote or like, post or share bot conversations within or outside Whisper AI. All material you upload, post or display within Whisper AI, and any results you receive in response to prompts (or other input) from bots accessible through Whisper AI ("Robot-Generated Content"), will collectively be referred to as "Your Content".
Other users may ask similar or identical questions to yours on Whisper AI and receive responses from the bot. Content received by other users is not considered your Content.
4.2 Your Robot. Whisper AI may allow you to create bots powered by third-party LLMs or add your own bots to Whisper AI for users to interact with (each bot, a "your bot"). Your bot will be associated with your Whisper AI profile name. You are under no obligation to create a bot, but if you choose to create a bot, you are responsible for ensuring that the content is legal and does not violate these Terms. Whisper AI may, in its sole discretion, remove your Bot if it violates these Terms, our policies, or applicable law. Whisper AI is not responsible for your Bot, any of its content, or the use of your Bot by others.
4.3 Ownership. You retain ownership of your Content, subject to the non-exclusive rights granted in Section 4.5 below.
4.4 Your Responsibilities. You acknowledge and agree that the bots accessible through Whisper AI will answer your questions based on knowledge obtained from various sources. We reserve the right to block, remove if your content or your bot violates these Terms, our policies or violates any applicable law or regulation, or if it creates a risk for Whisper AI or negatively affects the experience of other Whisper AI users. and/or the right to permanently delete your content or your robots.
5. Termination.
You may stop using Whisper AI or terminate these Whisper AI Terms of Service at any time, for any or no reason, by deleting your account in your settings. We may terminate your access to Whisper AI and/or these Whisper AI Terms of Service at any time, for any or no reason, upon [7] days prior notice to you, or upon government request, technology shutdown, change in our control, or Terminate immediately if we discover that you have violated these Whisper AI Terms. Any data collected prior to termination may continue to be used in accordance with these Terms. Upon termination of these Terms, the following provisions will survive: Section 3.4 (Feedback), Section 4.3, 4.4 (Your Content), Section 5 (Termination), and Section 7 (Disclaimers and Limitation of Liability).
6. Privacy.
As described in the Whisper AI Privacy Policy, we may collect certain personal information (including contact information, etc.) related to your use of Whisper AI. Your account information is anonymized before being shared with developers. Third-party developers may receive detailed information about your interactions with the bot on Whisper AI (including the content of your chats) in order to provide responses and generally improve the service. We will not ask you to share any sensitive personal information (such as credit card information, Social Security information, etc.) with the bot. Your voluntary disclosure of such personal information to third parties on our platform may be beyond our control and subject to various risks, and you will be solely responsible for the disclosure of such personal information. Our services are intended for users in non-EU areas and are not applicable to European Union (EU) laws and regulations, including but not limited to the EU General Data Protection Regulation (GDPR).
7. Disclaimer and Limitation of Liability.
Our maximum aggregate liability to you for loss or damage suffered by you out of or in connection with your use of the Whisper AI Services or these Terms is limited to your use of the Whisper AI Services giving rise to the claim within the preceding twelve (12) months Amount paid to Whisper AI.
We cannot guarantee the availability of any bots, features or services of Whisper AI or provided through Whisper AI. While we will continue to develop new features, add bots, and improve Whisper AI, if they pose a risk to Whisper AI, Whisper AI users, the third parties that power the bots, or are inappropriate from a business perspective or for any reason in our sole discretion However it makes sense, we may add or remove features or bots without notice to you, limit the use or availability of features or bots entirely (or only in certain places or for certain users). We also cannot guarantee that your use of Whisper AI will be error-free, interruption-free or that you will not experience service interruptions. We are not responsible for any errors, interruptions or interruptions in service that may occur.
